Mr. Shelesh Nawal, Jamabandi Commissioner, emphasised the need for more consistent and effective interaction with CREDAI Maharashtra. He suggested that regular meetings and interaction sessions should be organised with CREDAI Maharashtra to understand the practical difficulties, suggestions and expectations of developers. This would not only help in communicating information about various initiatives of the department directly to CREDAI members but also facilitate timely solutions to practical issues faced on the ground.
A key feature of the CREDAI Maharashtra Maha Samwad was that each government department presented its new as well as currently operational systems, processes and initiatives. This was followed by a question-and-answer session, providing developers with an opportunity to interact directly with the officials. Developers presented their various issues, challenges and suggestions before the concerned officials, who provided the necessary clarifications and guidance.
As a result, the Maha Samwad was not merely an information-sharing platform but emerged as an effective forum for direct, constructive and issue-oriented dialogue between the administration and developers.

The session covered important issues including Red Line–Blue Line, FSI for Gunthewari plots, BPMS, Online Building Permission, the facility for payment of Compensation/compounding charges for approval of layouts with existing buildings, consideration of the area mentioned in the 7/12 extract for Amenity Space, provisions relating to Utility/Transformer/Sub-Station, and the 15 per cent premium being levied for planned residential areas in 11 districts.
CREDAI Maharashtra raised the issue that although the objective of the online Building Permission process is to reduce the number of documents and expedite the approval process, in practice, physical files are also required to be submitted along with online documents, resulting in a duplication of work and additional burden.
The difficulties arising due to the absence of the previously available facility for payment of Compensation Amount/compounding charges for approval of layouts with existing construction in BPMS were also brought to the attention of the authorities.
An explanation was also sought regarding the technical and scientific basis for the 2,000 sq. m. threshold under UDCPR Regulation 3.6 for provisions relating to Utility/Transformer/Sub-Station for plots measuring less than 2,000 sq. m.

Particular discussions were held on the legal inconsistencies in the process of registering a Cooperative Housing Society after the formation of an Apartment Association under a Deed of Declaration, difficulties faced by Apartment Associations while obtaining PAN Cards and opening Bank Accounts, the facility for delayed registration of old Deeds of Declaration, and the effective implementation of the Maharashtra Government Gazette notification dated September 7, 2020, concerning Apartment Redevelopment.

The session also discussed issues arising in cases where an apartment owner has acquired ownership rights through a Deed of Apartment, particularly questions concerning the requirement of Conveyance or Deemed Conveyance, and the unnecessary disputes that may arise between developers and apartment owners as a result.
Furthermore, the need to provide an effective mechanism for Deemed Conveyance, wherever applicable under law, in cases where the developer is willing to execute Conveyance but does not receive cooperation from society members was highlighted.
